Stamp Act of 2006

Preamble

This regulation is granted in accordance with the provisions of the Cabinda National Bank Act dated February 9, 2006: its Executive Regulations, directives and any amendments thereto it being found that the production of official and fiscal stamps are necessary to the carrying out of the mandates of the National Bank Act.

Stamp Advisory Committee

In order to facilitate the carrying out of this Act, a Cabinda Stamp Advisory Committee may be designated to provide advice on the design, issue, selection, production and distribution of stamps. The Advisory Board shall report to the Governor of the National Bank or his designee. Membership on the Committee may include experts in the fields of philately and history.

National Philatelic Bureau

In order to facilitate the carrying out of this Act, a Cabinda National Philatelic Bureau may be created under the Governor of the National Bank to promote and distribute Cabinda stamps for philatelic purposes. The Attaché of the National Philatelic Bureau shall be appointed and serve under the Governor of the National Bank and will be the Republic of Cabinda’s liaison with the International Society for Portuguese Philately and other learned societies.

Official Stamps

The production of non denominated postage stamps for official use is hereby authorized in quantities deemed necessary for use by the Office of the Presidency of the Republic, the Diplomatic Corps, the Office of the Attorney General, the Cabinda Law Society, the Cabinda National Bank and the Self Defence Force of Cabinda.

A single official stamp may be affixed to correspondence carried by diplomatic pouch or courier between the officials of the Republic or addressed to allied organizations including FLEC-FAC, UNPO, and peoples and organizations that recognize the Republic of Cabinda. Any other usages are not authorized by this Act.

Official stamps may be created by an appropriate overprint on stamps of the foreign occupying country of Angola with an obliterating overprint “Republic of Cabinda” and “Official.” A limited number of stamps may be sold to collectors at a face value of CBE 1 (one) or - CFA 1 (one) only for the "Emergency issues" - through the Philatelic Bureau of the Cabinda National Bank or its designated agents.

Fiscal Stamps

A - The production of denominated fiscal stamps for official use is hereby authorized in quantities deemed necessary for use by the Office of the Presidency of the Republic, the Diplomatic Corps, the Office of the Attorney General, the Cabinda Law Society, the Cabinda National Bank and the Self Defence Force of Cabinda.

B -Emergency Fiscal stamps may be created by an appropriate overprint on stamps of the foreign occupying country of Angola with an obliterating overprint “Republic of Cabinda,” “Fiscal,” and a value in Cabindan Escudos or CFA converted. A limited number of stamps may be sold to collectors at face value through the National Philatelic Bureau of the Cabinda National Bank or its designated agents.

The following denominations in CBE are authorized: 0.50, 1.0, 2.5, 5, 10, 25, 50.

A partial schedule of uses follows:

Attestation by Diplomatic or Government Personnel– CBE 0.50

Notarial Fee – CBE 2.5

Cabinda National Bond Transfer or Reissuance Fee – CBE 25

Law Society Application Fee – CBE 50

Property Transfer Tax – 1% of transaction value to a maximum of CBE 300.

Issuance Limits

Total number of official stamps produced shall not exceed 10,000 exclusive of specimens. Specimen copies shall be provided to the Republic of Cabinda and its agents for the purpose assessing quality and presentational use and shall be marked Specimen or Muestra in a prominent location on the front or back of the stamp. No more than 500 Specimen official stamps of any type shall be produced with 100 each reserved for use of the Office of the Presidency, the National Bank, and the Attorney General and 50 each for the Philatelic Bureau and Stamp Advisory Committee.

Total face value of fiscal stamps produced shall not exceed CBE 100,000 exclusive of specimens. Specimen copies shall be provided to the Republic of Cabinda and its agents for the purpose assessing quality and presentational use and shall be marked Specimen or Muestra in a prominent location on the front or back of the stamp. No more than 500 Specimen fiscal stamps total shall be produced with 100 each reserved for the use of Office of the Presidency, the National Bank, and the Attorney General and 25 each for the National Philatelic Bureau and Stamp Advisory Board.

No other stamps are authorized.

This Law may be cited as the Stamp Act (Cabinda) 2006.

EMERGENCY ISSUE OF CABINDA POSTAGE STAMPS

FIRST NEW STAMPS IN CABINDA SINCE 1920

In furtherance of the Republic of Cabinda’s civil society initiative and to dispel Angolan propaganda regarding Cabinda’s current political situation, the Republic of Cabinda has issued an emergency set of stamps overprinted on an obsolete Angolan flora and fauna issue. The stamps all are denominated 500 Central African Francs and are intended to be used by the Cabindan government, consular officials, and in the liberated zones of Cabinda for both postage, official courier, and fiscal use.

A future definitive issue is planned based on Cabinda’s new currency the Cabinda Escudo. Cabinda formally known as the Portuguese Congo last issued stamps in 1920 while a Portuguese colony. Cabinda has been independent since 1975 but its capital and offshore oil fields have been occupied by Angola. A low intensity civil war is ongoing.
